직원수 4인 또는 그 이하 회사로서, 연간 회사 순이익이 100만불이 안되는 경우, 회사는 다음과 같이 직원에게 무급 휴가를 제공한다. 

    근무 30시간당 1시간의 휴가
    1년간 최대 40시간 한도
    사용하지 않은 휴가 시간은 다음 해로 이월된다. 그렇다 해도, 1년간 최대 40시간의 휴가를 초과하여 사용할 수 없다.
    사용하지 않고 퇴사할 경우, 회사가 보상해줄 의무가 없다.

연간 회사 순이익이 100만불이 넘는 경우, 회사는 직원에게 유급 휴가를 제공하여야 한다. 그 나머지 사항은 위와 동일하다. 
 

NYC Employers Must Comply With New Safe And Sick Leave Obligations

Employers with four or fewer employees with a net income below $1 million provide unpaid safe/sick leave  up to 40 hours per year
The hours are accrued at a rate of one hour for every 30 hours worked.
Employees must also be allowed to carry over any unused sick leave into the following calendar year.
However, employers are not required to allow employees to use more sick leave than the accrual limits (40 hours per calendar year).
Payout of any unused sick leave upon termination of employment is not required.
